Pending Cases

Appleton Blady & Magananimo is currently handling class or representative claims against the following employer defendants:

  • 21st Century Insurance - alleged mis-classification of employees as exempt from overtime;
  • Countrywide Home Loans - alleged mis-classification of employees as exempt from overtime;
  • Evapco, Inc. - claims on behalf of hourly employees;
  • Lantz Security - claims on behalf of hourly security guards;
  • Southern California Permanente Medical Group (Kaiser Permanente) - alleged mis-classification of Certified Registered Nurse Anesthetists as exempt from overtime;
  • Frontier Homebuilders, Inc. - alleged mis-classification of employees as exempt from overtime.

Current Class Investigations

Appleton Blady & Magnanimo is investigating potential class action claims against other employers, including claims for:

  • Termination of disabled employees upon expiration of Family Medical Leave and/or California Family Rights Leave.
  • Failure to pay overtime at the regular rate to employees based on all compensation that must be included.
  • Failure to provide required meal period and/or rest breaks.
  • Mis-classification of employees as exempt from overtime.

Smart & Final - Hourly Warehouse Workers Settlement

The Class Representative on behalf of himself and the class members has entered into a settlement agreement. On January 28, 2008, the Los Angeles Superior Court granted preliminary approval of the settlement. The settlement still must be finally approved by the court. The dates for making a claim, excluding oneself or objecting to the proposed class settlement are contained in the Notice of Proposed Class Action settlement available in .pdf format below.

Chemical Waste Management, Inc. - Hourly Workers (Kettleman Hills Facility)

The Class Representative on behalf of herself and the class members has entered into a settlement agreement. On February 11, 2008, the Kings County Superior Court granted preliminary approval of the settlement. The settlement still must be finally approved by the court. We anticipate Notice of the Proposed Settlement to be mailed to class members in March.

Gregg Industries - Hourly Workers (El Monte)

The Class Representative on behalf of herself and the class members entered into a settlement agreement. On February 14, 2008, the Los Angeles Superior Court granted final approval of the settlement.
